POLICY: |
This policy stipulates where Mining Act documents can be filed and where Mining Act
fees can be paid.

MINING ACT: |
Section 6 of the Act states:
" (1) The Minister may appoint as many provincial mining recorders as
he or she considers advisable from among the officers or employees of the
Ministry. "
(2) A recorder has jurisdiction throughout Ontario. "
Mines and Minerals Division offices will vary as to which documents can be filed there.
The following pages detail where to file specified documents.

WHERE TO FILE: |
The Provincial Recording Office (P.R.O.) is the recording centre for Mining Act documents for
the province. Documents that the Mining Lands Consultants' offices
receive, for their mining division, are considered filed but not recorded.
The Mining Lands Consultants do not keep these
documents. They forward them to P.R.O. to record.
The documents are filed and the
Mining Lands Consultants conduct an initial review, before the documents are
forwarded to the Provincial Recording Office for recording. The Provincial
Recording Office is the only office where filed documents are available to clients, except for assessment work.
Clients can view digital versions of assessment work that have been approved
by the Minister. All Resident
Geologists offices have a computer available for clients to access the
Earth Resources Mineral Exploration Website (E.R.M.E.S.).
It contains all assessment work reports for
the province. Resident Geologists also have a library of hard copies of
assessment work reports for mining lands in their
district.
NO DELIVERY OR PICKUP OUTSIDE
OF SPECIFIED OFFICES
Mining Lands Section staff will not pick up Mining Act documents at a bus depot,
airport, courier office or any other location outside of specified Ministry
offices. Nor will Mining Lands Section staff deliver Mining Act documents for
clients.
The client is responsible for delivering Mining Act documents directly to a
Ministry office as set out below in this policy.
DISRUPTION OF SERVICE - The client is responsible for filing required documents in the Provincial Recording Office
(P.R.O.) and Geoscience Assessment Office (G.A.O.) by the deadline set within
legislation. If for any reason there is a disruption in service at a Mining Lands Consultant's office, or other Ministry offices that offer Mining Lands
services, the client must file the document in P.R.O. or G.A.O. by the deadline.

TELEPHONE TRANSMISSIONS
FILING BY TELEPHONE TRANSMISSION: |
Refer to subsection 10(1) of
General Regulation 113/91, for a list of Mining Act documents which can be
filed through telephone transmission. Section 12 of
the General Regulation sets 4:30 p.m. local time as the final time of filing
by fax for receipt on that day.
TRANSMITTING FOR CLIENT - Staff of Mining
Lands Consultant’s Office or Government Information Centres can transmit
(fax) for a client, any Mining Act document for any mining
division providing the document is of a size that can easily be transmitted.Resident Geologist's staff in Tweed
and the Mines and Minerals Information Centre at Queen's Park in Toronto
will collect the appropriate fees for Applications for Prospector’s Licences
and Application to Renewal Prospector's Licence and they sell claim tags. TOLL FREE - Toll free telephone
transmission (fax) lines are available.

MAIL FORWARDING CENTRES: |
Specified offices of the Ministry of Northern Development and
Mines will serve as mail forwarding centres for any
Mining Act documents, for any mining
division. The mail will be forwarded, free of charge, through provincial government mail
to Sudbury. See the addendum at the end of this policy, for the specified offices.

Documents
" forwarded " are not considered filed until
they are received and accepted for filing in P.R.O. or G.A.O. (assessment
work). If a client has a time sensitive

Updated claim maps and Mining Claims Information (M.C.I.) are available for viewing on the Ministry's
internet site.
Computer terminals are available in the following offices for clients to access
claim maps or M.C.I.:
- Mining Lands Consultants;

the Mines and Minerals Office in Toronto;
- Resident Geologist's field office in Beardmore
- Government Information Centres as specified in the addendum
Page-sized claim maps can be printed from the internet for a fee. A
client can order full-sized claim maps from the Mines and Minerals Publications Services Office. The addresses and
phone numbers are listed at the end of this policy.

PROSPECTOR'S LICENCE: |
A client can obtain a Prospectors Licence form
as
well as pay for the
licence or renewal in:
- Mining Lands Consultants offices,
- Resident
Geologist's office in Tweed and the Mines and Minerals Office in Toronto;
- Government Information Centres as specified in the
addendum
The licence application is processed in the Provincial Recording Office. Clients can obtain the form from the
Mining Lands website.
Please allow an average of 2 days for issuance of
the licence plus mailing time.

PROVINCIAL RECORDING OFFICE: |
WHERE - city of Sudbury.
FEES - All
Mining Act fees can be paid in the Provincial Recording Office
(P.R.O),
through acceptable methods of payment:
- cash or cheque
- Master Card, Visa, American Express
- debit cards
The Ministry of Northern Development and Mines has
no ability to invoice clients.
Clients must provide their charge card number if filing by telephone
transmission (fax) to P.R.O. Clients are encouraged to provide their charge card
number by calling the office that they are faxing to (1-888-415-9845), rather
than writing the card number on a fax.
ACTIVITIES - Staff of the Provincial Recording Office will accept documents to be
filed in any mining division. Staff will issue all notices, postings, conduct all
examinations and other functions required to be done in the Recording Office under the
Mining Act.
All documents are recorded and filed in the Provincial Recording Office. All orders issued under the Mining Act, except
under Part VII, are recorded in the Provincial Recording Office

GEOSCIENCE ASSESSMENT OFFICE: |
WHERE - city of Sudbury
FILING - The following assessment work documents can be filed in the
Geoscience Assessment Office:
- the assessment work report and accompanying work declaration form
- the form " Certificate Confirming Notice of Intention to Perform Assessment
Work ", or letter of written consent under clause 78(3)(c) of the Mining Act
- the form " Application to Distribute Banked Assessment Work Credits
"
- a letter authorizing an agent to act on the clients behalf

THUNDER BAY MINING DIVISION: |
WHERE TO FILE - in the office of the Mining Lands Consultant located in the
city of Thunder Bay or in the Provincial Recording Office in Sudbury.
Assessment Work - Clients also have the option of filing, in the Geoscience Assessment
Office, all assessment work documents, except an application for extension of time
to perform and file assessment work.
WHAT TO FILE - originals of any Mining Act documents for mining lands in
the Thunder Bay Mining Division.
FEES - A client may pay any filing fee under the Mining
Act, to the Thunder Bay Mining Lands Consultant.
DOCUMENTS MAILED OR SENT BY COURIER - Clients who normally file
Mining Act documents by mail or courier will be encouraged to send documents directly to the
Provincial Recording Office.
TELEPHONE ACCESS - A toll-free telephone line, 1-888-415-9845, is available for clients to
call the Provincial Recording Office the Geoscience Assessment Office, or any Mining Lands
Section staff.
TELEPHONE TRANSMISSION - Any Mining Act document, can be transmitted
(faxed) for a client to the Provincial Recording Office or Geoscience Assessment Office
(assessment work) for the set
fees. However, the document must be eligible for filing by transmission, under subsection

WHERE TO FILE - in the office of the Mining Lands Consultant located in the town
of South Porcupine or in the Provincial Recording Office in Sudbury.
Assessment Work - Clients also have the option of filing, in the Geoscience Assessment
Office, all assessment work documents, except an application for extension of time
to perform and file assessment work.
WHAT TO FILE - originals of any Mining Act documents for mining lands in
the Porcupine Mining Division.
FEES - A client may pay any filing fee under the Mining
Act, to the Porcupine Mining Lands Consultant.
DOCUMENTS MAILED OR SENT BY COURIER - Clients who normally file
Mining Act documents by mail or courier will be encouraged to send documents directly to the
Provincial Recording Office.

Southern Ontario Mining Division . The client must send all Mining Act
documents to Sudbury for filing.
