Summary of Common Errors when filling out the Distribution of Banked Credits Form

  1. Incorrect information is listed for the recorded holder(s) such as client, phone and fax numbers;
  2. The contiguity sketch is not included when assigning assessment credits to contiguous claims;
  3. The contiguity sketch is not legible and/or does not outline the contiguous link between the claims;
  4. Unsigned/undated Certification by recorded holder or agent;
  5. An agent or optionee files the distribution for the recorded holder without including written authorization from the recorded holder;
  6. The recorded holder authorizes a company, however the employee submitting the application is not authorized as agent for the company;
  7. Two or more Work Declaration Numbers are listed in column 1;.
  8. The incorrect Work Declaration Number is listed in column 1 or is not listed at all;
  9. The current plus five year allowance is exceeded when applying or assigning credits to claims;
  10. Applying or assigning too little to maintain the claim in good standing (typically caused by not knowing or indicating the wrong number of units for the claim(s));
  11. Exceeding the yearly assignment of $24,000 per unit to a maximum of $96,000 for unpatented claims or $1,500 per hectare to a maximum of $96,000 for leases and patents (note that applying to the claim itself is not considered an assignment of credit);
  12. Mathematical mistakes (always make sure that the total of column 4 equals the total of column 5);
  13. Numerous contiguity problems, based on the parameters of geography, ownership/beneficial interest and/or time, as summarized below:

Claims are not contiguous in terms of geography:

The claim block is separated by Crown Land and/or claims/leases/patents held by other recorded holder(s).

Claims are not contiguous in terms of time:

Some claim(s) receiving the credit were recorded after the original (parent) work was completed.

Claims were forfeited but later re-staked by the same recorded holder(s). If the original claims were important in providing a contiguous linkage, then the linkage has been broken for all work performed prior to the recording of the new staked claim(s).

Claims are not contiguous in terms of beneficial interest or ownership:

A person or company acquires a beneficial interest or ownership in a block of mining lands (Block A) that is geographically linked to a group of their own claims (Block B). The person or company then wants to assign work credits from the mining lands they acquired (A) onto their own claims (B). The person or company may only assign from Block A to B if they had a beneficial interest in Block A from the time the work was performed through to the filing of the distribution of assessment work credits.

A person or company acquires a beneficial interest/ownership in Block A and wants to assign/apply reserve work credits within Block A. If the person or company did not have an interest/ownership when the work was performed then the reserve credits on any given claim within Block A can only be applied or assigned within Block A.
