Requirements to Surrender Mining Lands
Holders of Mining Licences of Occupation, Mining Leases and
Mining Patents can surrender their lands/mining rights to the
Crown at no charge, by submitting an "Application to Surrender
Mining Lands/Mining Rights form. The form should indicate:
- the land registry office
- the parcel and PIN number
- the description of the land (lease number, township, lot,
concession, mining claim, etc.)
- the legal rights being surrendered (mining rights only,
surface rights only or surface and mining rights (please note
that leases and licences must be surrendered in their entirety)
- all owners must sign the form or submit their own form (if a
company, signature must be by authorized personnel)
Other documentation required:
- copy of the parcel register/title abstract and any PIN that
may have been created for the land from the Land
Registry Office
- a tax certificate, showing that municipal tax/provincial land
tax has been paid (only if surrendering surface
rights)
- an Affidavit
verifying that there are no hazards on the property in question
(all owners must sign the form or submit their own form)
- any outstanding tax/rent due on property
