Mining Act

As part of the Mining Act Modernization initiative, MNDM will be introducing new set of regulatory provisions that support the updated Mining Act.

These proposed provisions would introduce new rules such as:

  • undertaking early exploration activities, including reclamation requirements and compliance measures
  • Aboriginal notification and consultation for certain early exploration activities, closure plans for advanced exploration projects and mines and for voluntary rehabilitation projects.
  • Withdrawals from staking or surface restrictions for sites of Aboriginal cultural significance
  • requirements for prospectors to take a Mining Act awareness program
  • assessment work provisions for mining claims

On March 12, 2012 we posted our regulatory proposals for the second phase of new regulations under the Mining Act on Ontario’s Regulatory and Environmental Registries.

Your feedback is important. Take the time to provide comments on the proposals on these Registries before the postings close on May 1, 2012.

Modernizing Ontario's Mining Act

Bill 173- An Act to Amend the Mining Act passed Third Reading in the Legislative Assembly on October 21, 2009 after extensive review through hearings held by the Standing Committee on General Government. The resulting Mining Amendment Act, 2009, received Royal Assent on October 28, 2009.

The legislation modernizes the mineral development process, in Ontario, through amendments to the Mining Act, related regulations and policies. Much of the proposed Act enables processes that will be detailed in the regulations, which would be developed throughout 2009-2010. The Ministry of Northern Development, Mines and Forestry will continue consultations with Aboriginal communities and organizations and stakeholder groups in development of regulations.

Workbook on Development of Regulations

MNDMF has developed a workbook that will help First Nation and Métis communities, mineral industry stakeholders and interested members of the public provide guidance on the development of regulations for the province’s modernized Mining Act.
